# Terms and Conditions

These Terms and Conditions apply to your use of the CAD Projects website at `https://cadprojects.com.au`, including the software pages, downloads, documentation and support materials (the **Website**).
The Website is operated by **CAD Projects Australia**, trading as CAD Projects (**CAD Projects**, **we**, **us** or **our**), ABN 30 160 773 571, of 17 Pretoria Parade, Harrington, NSW, Australia.
By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
## 1. About the Website
The Website provides information about CAD Projects and its software products, including CompositeWorks for Rhino. We may provide product descriptions, demonstrations, documentation, trial access, support information and links to third-party services.
Information on the Website is general information only. CompositeWorks is a software tool and does not provide engineering certification, structural design certification, class approval, regulatory approval, manufacturing approval or professional advice. You remain responsible for independently checking all project inputs, calculations, outputs and decisions.
## 2. Software licences and the EULA
Downloading, installing or using CompositeWorks is also subject to the CompositeWorks End User Licence Agreement (**EULA**). If these Terms conflict with the EULA on a matter concerning installation or use of CompositeWorks, the EULA applies to that matter.
You must not misuse the Website or software downloads, attempt to bypass licensing controls, introduce malicious code, interfere with the Website, or use the Website in breach of applicable law.
## 3. Purchases through FastSpring
CompositeWorks purchases are processed by FastSpring, which acts as the merchant of record and reseller for the transaction. Your checkout, payment, tax, invoicing and transaction relationship with FastSpring is subject to the terms and privacy notices presented by FastSpring at checkout.
CAD Projects does not directly collect or store your full payment-card details. FastSpring may provide us with order and customer information reasonably required to issue and support your licence, such as your name, email address, country, order reference, product and licence details.
Prices, currencies, applicable taxes and renewal terms are displayed at checkout. You should review those details before completing your purchase.
## 4. Trials
Where a free trial is offered, it is provided for the stated trial period and is limited to one trial per eligible user or computer unless we agree otherwise. You must not attempt to reset, extend, bypass or manipulate trial or activation controls.
A trial may be changed or withdrawn for future users. This does not affect rights that cannot lawfully be excluded.
## 5. Intellectual property
Unless otherwise stated, the Website and its content—including text, graphics, logos, product names, demonstrations, documentation and software materials—are owned by or licensed to CAD Projects and are protected by intellectual-property laws.
You may view and print reasonable extracts for your internal evaluation or use of our products. You must not reproduce, republish, distribute, sell, modify or commercially exploit Website content without our prior written permission, except where permitted by law.
Rhino and Rhinoceros are trademarks of Robert McNeel & Associates. CAD Projects and CompositeWorks are not affiliated with, endorsed by, sponsored by or supplied by Robert McNeel & Associates.
## 6. Third-party services and links
The Website and CompositeWorks may link to or rely on third-party services, including FastSpring, Rhino Package Manager/Yak, Keygen licensing services, website hosting providers and video or media platforms. Those services are controlled by their respective providers and may be subject to separate terms and privacy policies.
We are not responsible for third-party websites or services except to the extent required by law. A link does not necessarily indicate endorsement.
## 7. Website availability and accuracy
We aim to keep Website information accurate and available but do not promise that it will always be complete, current, uninterrupted or error-free. Product features, compatibility, pricing and availability may change. Material changes affecting a purchase will be handled in accordance with applicable law.
You are responsible for confirming that CompositeWorks is suitable for your operating environment and intended workflow. Current releases are designed for the Windows platform and supported versions of Rhino identified on the relevant product listing.
## 8. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Where our liability can lawfully be limited, it is limited to the maximum extent permitted by law. See our Refund Policy for information about remedies and refund requests.
## 9. Liability
To the maximum extent permitted by law, CAD Projects is not liable for indirect, incidental, special or consequential loss arising from use of the Website, reliance on general Website information, or the unavailability of the Website.
This clause does not limit liability that cannot lawfully be excluded or limited. Software-specific risk allocation and limitations are set out in the EULA.
## 10. Privacy
Our collection and handling of personal information is described in our Privacy Policy. Third parties involved in checkout, licensing or package delivery may separately collect personal information under their own privacy policies.
## 11. Changes to these Terms
We may update these Terms by publishing a revised version on the Website with a new “Last updated” date. Changes apply from publication and do not retrospectively remove rights that have already accrued.
## 12. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and CAD Projects submit to the courts having jurisdiction in New South Wales, subject to any rights you have to bring a claim elsewhere under applicable consumer law.
